The agreement in plain English.

1. Who you’re dealing with

Lispend is a real-estate public-records data subscription covering Florida and California, operated by Lispend LLC ("Lispend", "we"). Contact us at support@lispend.com.

2. Business use only

Lispend is a business-to-business tool sold to real-estate professionals — investors, wholesalers, agents, and the teams who support them. By subscribing you confirm you are using the service for a lawful commercial real-estate purpose, not for personal, household, or consumer use. When you subscribe we may ask for and verify basic business details (company name and your use case) to keep the platform commercial-only.

3. Not a consumer report (FCRA)

Lispend is not a consumer reporting agency and the data it provides is not a consumer report under the federal Fair Credit Reporting Act (FCRA) or any state equivalent. You MUST NOT use Lispend data, in whole or in part, to make decisions about a person’s eligibility for credit, insurance, employment, housing, or any other FCRA-covered purpose. Lispend surfaces public county-clerk filings for real-estate sourcing — nothing more.

4. What you’re paying for

A subscription to access county public-record distress filings in Florida and California — lis pendens and the other filing types on the counties currently shown live on /coverage, with additional list types as they ship on the roadmap. Your subscription tier determines the per-month row cap and county breadth, as listed on /pricing. Skiptrace is not part of any subscription: it is sold separately as pay-as-you-go credit packs, with their own refund terms in §8.

5. Free preview & trials

You can create an account and explore a free preview of the Lispend feed at no cost and with no card — enough to see coverage, freshness, and the shape of the data, plus a small daily sample of fully detailed leads. Beyond that sample, full row detail (owner, mailing/site address, parcel) and larger CSV exports require a paid plan; skiptrace requires separately purchased credits. We do not offer free trials on paid plans: Lispend includes exportable data and usage-based services from the first day, so the free preview above is the way to evaluate it before paying. Paid plans are charged at checkout, and the auto-renewal terms in §6 apply from the first payment.

6. Auto-renewal & recurring billing

Paid plans are recurring subscriptions. Before we take any payment, checkout shows you — clearly and conspicuously — the exact price, the billing interval (monthly or yearly, whichever you pick), and the fact that the plan renews automatically until you cancel. You give affirmative consent to those terms at checkout; we do not pre-tick that box for you. Payments are processed by our third-party payment processor; we do not store your card details.

• It renews until you cancel. At the end of each billing interval your plan renews for another interval at the then-current price for your tier, charged to the card on file.
• We remind you before we charge. We email you at least 3 days before each renewal with the amount and the date, so a charge is never a surprise.
• Price changes are opt-in. If we ever change the price of your plan, we email you first and the new price only applies after a renewal you’re free to cancel before.

Founder Lock renews annually like any other plan, with one difference: your price is locked at $997 for as long as you keep the seat. It never goes up.

7. Cancellation — kept easy

You can cancel any paid subscription any time from your Billing page by switching off auto-renew — or email support@lispend.com and we’ll cancel it the same business day. There is no “are you sure” maze and no phone call required. Cancellation stops all future charges and takes effect at the end of the current billing interval — you keep access until then, and you can switch auto-renew back on before that date. (Founder Lock seats: email support@lispend.com and we switch auto-renew off the same business day.)

Changing plans: upgrades take effect immediately, and you’re charged the prorated difference for the rest of the current billing interval. Downgrades take effect at your next renewal, and you keep your current plan until then.

8. 7-day satisfaction guarantee

If Lispend isn’t a fit, email support@lispend.com within 7 days of your first payment and we’ll refund your purchase, provided the account has only been used for reasonable evaluation.

For the guarantee, reasonable evaluation means you have exported, downloaded, synced, or otherwise retrieved fewer than 500 records in bulk and used fewer than 50 skiptrace credits. If either threshold has been exceeded, the product has materially delivered consumable data and the purchase is no longer eligible for an automatic refund.

We may still resolve unusual cases individually, including technical problems or clearly accidental purchases.

A refund ends paid access to the applicable plan. After the 7-day window, recurring plans can be canceled at any time to stop future renewals (see §7); we do not prorate the current billing period.

Founder Lock follows the same 7-day evaluation standard. Because it provides 12 months of access immediately, the same usage limits apply during the refund window.

Skiptrace credit packs: unused credit-pack purchases may be refunded within 7 days. Credits that have already been consumed are not refundable.

If you believe a charge is incorrect, contact us. A real person will review it.

This section applies to purchases made on or after 15 September 2026. Purchases made before that date remain governed by the refund terms in force when they were made.

9. Data accuracy disclaimer

Lispend sources filings from public county records. We clean and organize the data, but we don’t guarantee it is free of errors. Court records change as cases progress; a filing visible today may be voluntarily dismissed tomorrow. You are responsible for verifying any lead before taking action on it.

10. Acceptable use

Use of the data and the platform is governed by our Acceptable Use Policy, which is part of these terms. In short: source for your own deals, don’t resell the raw feed, follow DNC/TCPA/CAN-SPAM when you reach out, and don’t scrape or abuse the service. We may throttle, suspend, or terminate accounts that violate the AUP.

11. Service availability

We aim for a daily pull before 9 AM Eastern. If a county portal breaks or pulls fail for more than 48 hours, your affected subscription will receive a prorated credit on the next billing cycle.

12. Disclaimer and limitation of liability

The service and the data are provided “as is” and “as available.” To the maximum extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, and we do not promise the service will be uninterrupted or error-free.

To the maximum extent allowed by law, Lispend’s liability for any issue with the service is limited to the amount you have paid in the most recent billing cycle, and Lispend is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost deals. We don’t assume liability for downstream business decisions made using the data.

Your responsibility for your use

You agree to defend and indemnify Lispend LLC against claims, fines, and costs (including reasonable legal fees) arising from your use of the data or the service, including the calls, texts, emails, and mail you send, and any breach of these terms or the Acceptable Use Policy.

Governing law

These terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Bernalillo County, New Mexico, and you and Lispend agree to their jurisdiction.

13. Your privacy & data rights

What we collect from you, why, how long we keep it, and how to request a copy or deletion (including your CCPA / GDPR rights) is covered in our Privacy Policy.

14. Changes to these terms

If we make a material change to these terms, we’ll email subscribers before it takes effect and update the “last updated” date above. Continuing to use the service after a change means you accept the updated terms; if you don’t agree, you can cancel under §7.
