Polk County probate records and estate property
Estates are administered in the 10th Judicial Circuit through the clerk of court in Bartow. Florida probate procedure is the same in every county — we cover the statute and the timeline here. What is not the same is the property that comes out of it, which is what this page is about.
What probate looks like in Polk County
Polk’s probate estates come mostly from the older half of the county: Lakeland, Winter Haven, Bartow and the retirement parks along US 27 and around the lakes, not from the new subdivisions along I-4 near Davenport. Many of the owners leaving an estate here bought decades ago, so a good share of these houses carry no mortgage at all.
The property you will actually find
Concrete-block ranch houses from the 1950s to the 1970s in Lakeland and Winter Haven, manufactured homes in 55-and-over parks and on owned lots across the citrus belt, and lake-front property around the Winter Haven Chain of Lakes.
Concentrated around Lakeland, Winter Haven, Bartow, Haines City, Davenport.
What to do differently here
Check how a manufactured home is titled before you make an offer. If it was never declared real property, the home carries its own vehicle-style title that has to pass through the estate separately, and a buyer who reads only the deed can miss it. On lake-front lots, confirm the flood zone and the seawall before you settle on a price.
